These Terms & Conditions serve as the foundation of our partnership. At Mathis Construction, we believe that clear expectations lead to exceptional results. By engaging our services, you agree to the following framework, designed to ensure the integrity of your build.
1. Engagement & Scope
All projects, from custom estates to major renovations, are governed by a specific Master Services Agreement (MSA) or Construction Contract. These documents supersede these general terms where specific details are defined. Our scope is strictly limited to the written agreement and approved Change Orders.
2. Financial Framework
- Estimates vs. Fixed Bids: Unless explicitly stated as a "Fixed Bid," project costs are estimates based on current material and labor rates.
- Draw Schedules: Payments are structured around project milestones (e.g., Foundation Pour, Framing, Drywall). Invoices are due upon receipt to maintain the critical path schedule.
- Deposits: A non-refundable deposit is required to reserve a slot in our production calendar.
3. Change Management
In custom building, evolution is natural. However, to maintain budget and schedule discipline:
- All changes to the original scope must be documented in a written Change Order.
- Work on changed scope will not commence until the Change Order is signed and any associated costs are approved.
- Change Orders may impact the final completion date.
4. Site Conditions & Access
The Owner warrants that they own the property and have the right to authorize construction. Unforeseen site conditions (e.g., ledge rock, hidden decay in remodels, hazardous materials) are not included in the base scope and will be addressed as a Change Order.
5. Timeline & Completion
We take pride in our efficiency, but quality cannot be rushed. Schedules are estimated target dates. Factors beyond our control—including weather events, supply chain disruptions, and municipal inspections—may extend timelines. "Substantial Completion" is defined as the point when the space is fit for its intended use, even if minor punch-list items remain.
6. Warranty & Care
Mathis Construction stands behind our craft.
- Workmanship: We provide a standard 1-year limited warranty on workmanship and materials installed by us.
- Structural: We adhere to all Washington State statutory warranty requirements for structural integrity.
- Exclusions: Normal wear and tear, owner maintenance negligence, or third-party alterations are not covered.
7. Governing Law
Any disputes arising from this agreement shall be vetted through mediation first. If unresolved, they shall be governed by the laws of the State of Washington, with venue in Spokane County.
